The Florida Supreme Court in Johnson v. Davis, 480 So.2d 625 (Fla. 1986), stated that through the sale of residential real property, the Seller must disclose latent defects if they possess knowledge of conditions materially affecting the value of the property of which are not readily observable or already known to the buyer. This applies even when there is an “as is” contract.
